Prenuptial & Postnuptial Marital Agreements

Texas is a community property state, meaning property acquired during marriage is generally presumed to belong to both spouses unless proven otherwise. Spouses may, however, change these default rules through a written marital agreement. Individuals also maintain the right to transfer or gift their property during their lifetime or through estate planning instruments.
